Organizer
The organizer of the sweepstakes is MAHLE Aftermarket GmbH, located at Pragstraße 26 - 46, 70376 Stuttgart, Germany (hereinafter referred to as the "Organizer" or "MAHLE").
This sweepstakes is in no way affiliated with Facebook (FB) and is not sponsored, endorsed, or administered by Facebook. All inquiries and information regarding the sweepstakes should be directed to MAHLE, not to Facebook.
Acknowledgment of Terms and Conditions
By participating in the sweepstakes, participants agree to these terms and conditions. The channels that promote the sweepstakes and invite participation will provide a link to these terms and conditions.
Eligibility
Participation is open exclusively to individuals who are at least 18 years of age and reside in Europe. Participation must be in one's own name.
Employees of the Organizer, their family members, as well as employees of companies within the MAHLE Group, service providers, or partners involved in the creation or execution of the sweepstakes, and their family members, are excluded from participation.
Each participant may enter the sweepstakes only once. The Organizer reserves the right to disqualify participants who have entered the sweepstakes multiple times or have attempted to do so.
Manipulations, participation via sweepstakes clubs, and automated entries through sweepstakes robots are prohibited and will lead to disqualification.
If a participant is found to be ineligible after winning, the prize may be revoked and awarded to an alternate winner.
The determination of eligibility lies with the Organizer.
Duration, Prize, and Prize Fulfillment
The sweepstakes begins on June 13, 2024, and ends on July 14, 2024.
Prizes include 46 MAHLE soccer balls, 15 mini foosball tables, and a BBQ set consisting of a grill barrel, a mini refrigerator, and a MAHLE drinking straw set.
Travel and accommodation expenses for the winners, as well as other incidental costs and personal expenses, are not covered by MAHLE.
Participants automatically enter the sweepstakes if they correctly predict either:
The two teams from a preliminary group that will advance to the knockout round. The contact form must be fully completed and submitted in the relevant article.
The winner of a match in the knockout phase. The contact form must be fully completed and submitted in the relevant article.
Winners will be randomly selected from all participants.
Winners will be notified of their prize via email within one week after the draw and will be asked to confirm their contact details.
If winners do not confirm their acceptance of the prize within 2 business days by providing their contact details, the prize will be forfeited and awarded to an alternate winner. Winners may also decline their prize, in which case a new winner will be drawn.
The prize will be mailed to the address provided in the prize confirmation, but only within Europe. Once the prize is dispatched by mail, the risk of loss or damage transfers to the winner. The Organizer is not responsible for delivery damages or losses. Participants are responsible for the accuracy of the contact details they provide. If a prize is incorrectly assigned due to erroneous information, the claim to the prize is forfeited.
The prize cannot be paid out in cash, substituted with other items, exchanged, or transferred to another person.
Participation Terms
Participation is free, voluntary, and independent of the purchase of goods or services. Additional costs may arise for the use of data services.
Participants enter the sweepstakes by submitting their prediction and completing and submitting the contact form in the relevant EM-Tippspiel article.
Submissions via mail or any other method are not permitted and will not be considered in the prize draw.
Participants' comments and submissions must not contain insults, false facts, or violations of competition, trademark, or copyright laws. If third-party claims arise due to rights violations, the participant will indemnify the Organizer from all claims. By participating, each entrant agrees to be responsible for any legal violations they commit.
The Organizer reserves the right to delete comments containing prohibited content, including but not limited to pornographic, glorifying violence, racist, or otherwise offensive content. The decision to delete comments is at the discretion of the Organizer.
Liability
The liability of the Organizer for damages is subject to the following exclusions and limitations unless otherwise required by law.
The Organizer is fully liable if the cause of damage is due to intent or gross negligence.
Furthermore, the Organizer is liable for the negligent breach of essential duties whose violation jeopardizes the purpose of the contract, or for the breach of duties whose fulfillment enables the proper execution of the sweepstakes and on whose compliance the contractual partners regularly rely. In this case, the Organizer is only liable for the foreseeable, contractually typical damage. The Organizer is not liable for the negligent breach of duties other than those mentioned in the preceding sentences.
These liability limitations do not apply in cases of harm to life, body, or health, for a defect after assuming a guarantee for the quality of a product, and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
As far as the liability of the Organizer is excluded or limited, this also applies to the personal liability of its employees, representatives, and agents.
Early Termination of the Sweepstakes
The Organizer notes that the availability and function of the sweepstakes cannot be guaranteed. The Organizer is entitled to terminate the sweepstakes early if its feasibility is no longer assured due to technical and/or legal reasons, such as technical problems (hardware and/or software errors, viruses in the computer system, manipulation, etc.), changes in terms of use, or other decisions. No claims arise for participants due to early termination.
Modification of Terms and Conditions
The Organizer expressly reserves the right to change these terms and conditions at any time, effective for the future. Participants will be informed of any changes.
Legal Recourse and Severability Clause
Legal recourse for the determination of winners is excluded. No correspondence will be conducted about the sweepstakes. The sweepstakes and these terms and conditions are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Stuttgart.
If any provision of these terms and conditions is invalid or incomplete, the validity of the remaining provisions remains unaffected. Invalid or incomplete provisions will be maintained with a valid content that comes closest to the meaning of the invalid content.
Data Protection
The Organizer collects, processes, and uses all personal data provided to the Organizer within the scope of this sweepstakes solely for the purpose of conducting the sweepstakes. The Organizer does not share this personal data with third parties, except for service companies based in Germany supporting the execution of this sweepstakes ("data processors").
Upon written or text-form request, participants can ask the Organizer at any time for information about the personal data stored by the Organizer, can request its correction or deletion, and can revoke consents to data protection.
